Terms of Service

These Terms of Service ("Terms") govern your use of the Saison platform ("Saison", "the service"). Saison is operated by Better Data Pty Ltd ("we", "us", "our"), registered in Australia. By creating an account or using Saison, you agree to these Terms. If you do not agree, do not use the service.
1. The service
Saison is a menu intelligence and sustainability analytics platform for restaurants. It includes recipe costing, menu performance analysis, seasonal and local sourcing recommendations, sustainability scoring, smart features, point-of-sale integrations, and reporting tools.
We provide the service on a software-as-a-service basis. The features available to you depend on your subscription plan.
2. Your account
- You must be at least 18 years old and authorised to enter into a binding agreement on behalf of yourself or the organisation you represent.
- You must provide accurate information when creating your account and keep it up to date.
- You are responsible for maintaining the security of your password and for all activity that occurs under your account.
- You must notify us promptly at hello@saisonapp.com if you suspect unauthorised access to your account.
- One person or organisation may maintain multiple restaurant profiles within an account. Accounts are non-transferable.
3. Subscriptions, billing, and trial
- Plans: Saison offers three subscription tiers — Essentials (A$9/month + GST), Pro (A$29/month + GST), and Group (A$69/month + GST). Prices exclude GST; 10% GST is added at checkout for Australian customers. Plan features are described on the pricing page and may evolve over time.
- Free trial: All paid plans include a 30-day free trial. No payment method is required to start the trial. We will not bill you unless you choose a paid plan at the end of the trial.
- Billing cycle: Paid plans are billed monthly in advance, in Australian Dollars plus GST, via Stripe. Your subscription renews automatically unless cancelled.
- Cancellation: You may cancel at any time from Settings → Billing. Access continues until the end of the billing period you have paid for. We do not pro-rate refunds for unused time, except where required by Australian Consumer Law.
- Price changes: We may change subscription prices. Material increases will be communicated by email at least 30 days before they take effect. You may cancel before the change applies.
- Failed payments: If a payment fails, we may suspend access until the issue is resolved. Persistent non-payment may result in account termination.
4. Your data and content
- Ownership: You retain ownership of all data you upload to Saison — your recipes, menus, ingredient lists, sales data, waste logs, and any analysis derived from them. We do not claim any intellectual property rights over your content.
- Licence to operate the service: You grant us a limited, non-exclusive licence to host, copy, process, and display your content solely as necessary to provide the service to you, including transmitting relevant data to our third-party processors (such as Anthropic for AI features and Stripe for billing).
- Aggregated benchmarks: We may use de-identified, aggregated data from across the platform to produce benchmarks and leaderboards. Your individual restaurant data is never disclosed in identifiable form unless you have explicitly enabled "Open" leaderboard mode.
- Data accuracy: You are responsible for the accuracy of the data you upload, including ingredient costs, recipes, and sales volumes. Saison cannot validate the accuracy of inputs.
5. AI features
- AI features (menu scanning, invoice scanning, recipe parsing, descriptions, reports, review analysis, Q&A) use third-party AI models, currently Anthropic's Claude API, under Anthropic's standard commercial API terms. Anthropic does not use your data to train its models, and may retain API inputs and outputs for a limited period under its data retention and usage policies before deletion. We do not have a zero-data-retention arrangement with Anthropic.
- AI features require your explicit consent before any data is sent to the AI provider. You can revoke consent at any time in Settings.
- AI outputs are suggestions, not professional advice. You are responsible for reviewing AI-generated content (menu descriptions, cost analyses, scanned data, recommendations) before relying on it. AI can produce inaccuracies or "hallucinations".
- AI usage is metered by your plan tier. Once your monthly allowance is consumed, AI features pause until the next billing period or until you upgrade your plan.
- We do not guarantee the accuracy, completeness, or fitness for purpose of AI outputs.
6. Point-of-sale and third-party integrations
- Saison can connect to point-of-sale systems (Square, Lightspeed, Toast) and accounting platforms (Xero, MYOB) where you authorise the connection. Connections use OAuth — we never see or store your third-party credentials.
- You are responsible for ensuring you have the right to authorise these connections on behalf of your business.
- Data quality from integrations depends on how those external systems are configured and maintained. We are not responsible for inaccuracies in data imported from third-party systems.
- You can disconnect any integration at any time from Settings → Integrations.
7. Acceptable use
You may not, and may not permit anyone using your account to:
- Use Saison for any illegal purpose or in breach of applicable laws.
- Attempt to access data belonging to other users or restaurants.
- Reverse-engineer, decompile, or attempt to derive the source code of Saison, except to the extent expressly permitted by law.
- Resell, redistribute, or sublicense access to Saison without our written agreement.
- Use automated tools (scrapers, bots) to access or extract data from Saison, except via documented APIs in accordance with their rate limits.
- Upload content that is unlawful, infringes others' rights, contains malware, or attempts to interfere with the service.
- Attempt to bypass plan limits, AI rate limits, or other technical controls.
8. Service availability
We aim to keep Saison available at all times, but we do not guarantee uninterrupted service. We may carry out maintenance, updates, or repairs that temporarily affect availability. Where possible, we give advance notice of planned downtime.
Some features depend on third-party services (Anthropic, Stripe, Square, Google, etc.). Outages or changes in those services may affect Saison.
9. Account suspension and termination
- By you: You may close your account at any time via Settings → Account → Delete Account.
- Effect of account deletion: Deletion is immediate and permanent. When you delete your account, your data — including all recipes, menus, ingredients, waste logs, integrations, and analysis history — is removed from our active production systems immediately and cannot be recovered. Routine encrypted backups created before deletion may persist for up to 30 days as part of normal backup rotation, after which the data is no longer recoverable from any of our systems. If you want a copy of your data, export it from Settings → Account → Export Data before deletion.
- By us: We may suspend or terminate accounts that materially breach these Terms, with at least 7 days' notice where practicable. For serious breaches (fraud, security threats, abuse of other users), we may suspend or terminate access immediately.
- Effect of termination by us: If we terminate your account for breach, your access ends immediately and your data is deleted on the same basis as above. You remain liable for any outstanding fees.
10. Australian Consumer Law
Our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these Terms is intended to exclude, restrict, or modify any consumer right or remedy that applies under the Australian Consumer Law where it cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, and subject to the section above:
- Saison is provided "as is" and "as available". We make no warranties beyond those that cannot be excluded by law.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, or loss of data.
- Our total aggregate liability to you for any claim under or in connection with these Terms is limited to the total fees paid by you to us in the 12 months immediately before the event giving rise to the claim, or A$100, whichever is greater.
- Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.
12. Intellectual property
The Saison platform, including its software, design, brand, and documentation, is owned by Better Data Pty Ltd and protected by Australian and international intellectual property laws. These Terms do not grant you any right to our trademarks or to use our brand without our prior written consent.
If you provide feedback or suggestions, we may use them without obligation to you.
13. Indemnity
You agree to indemnify and hold us harmless from any third-party claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of Saison, your violation of any law, or your infringement of any third party's rights.
14. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email and by displaying a notice in the app at least 14 days before they take effect. Your continued use of Saison after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your account before they take effect.
15. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising under or in connection with these Terms or your use of Saison will be subject to the exclusive jurisdiction of the courts of Victoria, Australia, unless mandatory consumer protection law in your jurisdiction requires otherwise.
